Unlike many of the lawsuits regarding Mr. Obama’s citizenship - which claim he was born on foreign soil - Mr. Donofrio’s case concedes that Mr. Obama was born in Hawaii as he claims. Mr. Donofrio contends, however, that Mr. Obama is not a “natural born citizen,” as Article II, Section I of the U.S. Constitution requires.
“Don´t be distracted by the birth certificate and Indonesia issues,” Mr. Donofrio said in a statement on the Citizen Wells Web site. “They are irrelevant to Senator Obama´s ineligibility to be president.
“Since Barack Obama´s father was a citizen of Kenya, and therefore subject to the jurisdiction of the United Kingdom at the time of Senator Obama´s birth, then Senator Obama was a British citizen ‘at birth,’ just like the framers of the Constitution, and therefore, even if he were to produce an original birth certificate proving he were born on U.S. soil, he still wouldn´t be eligible to be president.”

Thousands of people are jumping aboard a petition that demands documentation of President-elect Barack Obama’s eligibility to hold the highest office in the U.S., not just assurances from party officials. Within only a few hours of its launch, more than 10,000 petitioners today had joined the effort coordinated by WND founder and editor Joseph FarahA report accompany Farah’s petition explains the many questions raised about Obama’s eligibility, from an apparently fabricated “Certification of Live Birth” posted online to questions about what nation’s passport he used during to travel to Pakistan.
The signature total was over 45,000 by late Saturday evening.
As WND reported, one case is scheduled for a conference among U.S. Supreme Court justices Dec. 5.
If the U.S. Supreme Court justices is worth their salt they will enforce the showing of proof to The American people of Obama’s eligibility or not! My question is if there isn’t a problem then why would Obama withhold information and why would he had posted a fake BC on his own web page trying to fool the American people?

Answer: Because a fake birth certificate was NOT posted on Obama’s website. It’s only the tinfoil hat wearing brigade that says it’s fake, and there’s no proof whatsoever to back up their claim. And Obama hasn’t withheld information. He and his people willnot be hounded anymore by nutjobs.
Obama produced his birth certificate at least once, when the U.S. government issued him a passport.

He produced a copy on the Internet, for all to see. It wasn’t good enough for the naysayers. Skeptics claimed it was a forgery. How did they know? because they were self-appointed “Photoshop experts”!

We shall see who is right the Obama supporters or the people that say his birth certificate that he posted on his own site was a fake… all he has to do is turn his birth certificate over to the U.S. Supreme Court justices and they will make a ruling on it. We shall know more come the 5th of Dec from what I understand.
If the U.S. Supreme Court rules in Obama’s favor then be it but its the right of the America people to know the truth and taken Obama word isn’t good enough diogenes, Google’s word isn’t good enough diogenes as google is in the tank with Obama, FactsCheck.org has been in the tank with Obama and has Obama supporters running the site. And your compete lack of knowledge about the U.S. Supreme Court would shame a 10th grade civics student. SCOTUS isn’t and wouldn’t be looking at Obama’s birth certificate on December 2. They’re discussing whether or not four of the justices even think the matter is worth hearing about. I doubt that they will. In fact, I guarantee that, if they do decide to formally hear the case, it will only be to definitively rule, once and for all, that this nonsense is, indeed, nonsense.
SCOTUS isn’t the expert on forgeries, so they won’t examine the document. If it ever came to it, any judge would ask one simple question: did the appropriate authorities say it is an authentic birth certificate? Answer: yes, the director of the Hawaiian Dept. of Health says she’s seen the original, which is in the vaults, and it’s legit. END OF STORY. You don’t get to play junior-grade Columbo. Sorry, Lieutenant.

The American people are required to prove citizenship many times during a lifetime, I had to release my birth certificate when I joined the military, when I went to work for the government and many other times. Is Obama someone above the law just because he has people thinking he’s a black man? Obama is 50% White, and not even 25 percent black! So diogenes who is being racist? Obama more White than Black!

The “original document” as you term it is in the vault in the Hawaii Dept. of Health. The COLB he produced is a perfectly legal and valid document to all but tinfoil hat wearers and overeager rightwingnuts who cannot and will not accept the inevitable. (Hell, there are plenty of rednceks who will not accept the result of the CIvil War.)
GTP, for all those times you claim you had to produce your birth certificate, a COLB would have been legally sufficient in all cases. It isn’t about Obama being “above the law”. You know, even if the birth certificate shows that our Teleprompter Jesus was born in Kenya, he’s still good to go constitutionally. There were retroactive changes to immigration law in 1994 that will cover him. Of course, if he was born in Kenya, the birth certificat will show him up as a liar, but we knew that. I’m just curious to know if there’s something *else* embarrassing on the original.

You people are so ignorant, you’re scary. In many states (and it seems Hawaii is one of them) when you request a copy of your birth certificate, they routinely send you a COLB. It’s prepared at whatever date it’s requested. And BEFORE IT’S PREPARED the Dept. of Health goes back to the vault copy to get the accurate info.
Luke, you need to be careful when reading statutes, especially when you don’t know what you’re reading (or not reading). There’s not applicability dates on any of these provisions, so it’s not possible to tell if any of these subsections would apply to Obama or not (IF Obama were born overseas, which is simply not so).
As for lowering the bar “so darn low that anyone could get over it”, GTP, it’s still not low enough for you to clib over it, thankfully. You’d never convince more than a dozen voters that you’re aren’t mentally incompetent.

di, the Code is current as of 2007 — June, I think. The relevant provision covers births after 1952. Unless there’s some sort of problem with Congress awarding citizenship retroactively, Obama is a “citizen at birth,” even if Mom-based in Mombasa. Also, he’s a clown, although it is not clear whether he is a “clown at birth.”

Why would you think that? Lots of times, SCOTUS doesn’t even bother to announce cases on which they decided not to grant cert. They fade away into ignominy, the way they should.
SCOTUS “didn’t delay action”. They simply didn’t make any announcements and they went home to their homes and their lives for a weekend watching Army-Navy and NFL football.
This just goes to show how desperate bloggers will spin anything they can into a story.
